These Terms of Service ("Terms") govern your use of the Happiness is Blooming website located at happinessisblooming.com (the "Site") and any purchases made through it. The Site is operated by With Tiny Flowers LLC, doing business as Happiness is Blooming ("we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Happiness is Blooming is a premium handcrafted floral gift brand based in San Diego, California. We design and deliver fresh flower arrangements and custom floral sculptures, with local delivery available in the San Diego area.

2. Eligibility

By using this Site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are placing an order on behalf of another person, you represent that you have their authorization to do so.

3. Orders and Payment

3.1 Order Confirmation. All orders are subject to availability and confirmation. Placing an order constitutes an offer to purchase. We reserve the right to decline or cancel any order at our discretion, including in the event of pricing errors, product unavailability, or suspected fraudulent activity.

3.2 Pricing. All prices are listed in U.S. dollars and are subject to change without notice. Applicable sales tax will be added at checkout where required by law.

3.3 Payment. We accept payment methods as displayed at checkout. By submitting payment, you represent that you are authorized to use the payment method provided. Payment is processed securely through our third-party payment processors.

3.4 Delivery Information. Accurate delivery information is your responsibility. We are not liable for failed or delayed deliveries resulting from incorrect or incomplete addresses provided at checkout. Local delivery availability and windows are displayed on the Site at the time of purchase.

4. Cancellation Policy

4.1 Standard Arrangements. Our flowers are purchased fresh approximately 48 hours before your delivery date. For that reason:

Orders cancelled more than 48 hours before the scheduled delivery date will receive a full refund.
Orders cancelled within 48 hours of the scheduled delivery date are not eligible for a refund. Store credit may be offered at our discretion.
Orders that are out for delivery or have been delivered cannot be cancelled.

To cancel, email hello@happinessisblooming.com with your order number. Cancellations are not accepted through customer accounts and are effective when confirmed by us in writing. We will respond within one business day.

4.2 Custom Orders and Floral Sculptures. Custom pieces (such as floral sculptures, installations, and extra-large or custom-designed arrangements) are quoted individually and require advance flower purchases, sourcing trips, and design work. Custom orders are governed by the Custom Order Agreement provided with your quote, which includes the following terms:

Deposit: A 50% deposit is required to confirm your order and reserve your date. No materials are purchased and no date is held until the deposit is received.
Balance: The remaining 50% is due 10 days before the delivery or event date, before flowers are purchased. If the balance is not received by then, we may cancel the order under the first cancellation tier below.
Cancellation more than 10 days before delivery (before flowers are purchased): we retain 25% of the total order price for design work and date reservation, and refund any remaining amount paid.
Cancellation 10 days to 72 hours before delivery (after flowers are purchased): we retain 50% of the total order price for flowers, sourcing, travel, and design work.
Cancellation within 72 hours of delivery, or after construction has begun: no refund.
Date changes: We will try to accommodate a new date requested more than 10 days in advance. Changes requested after flowers are purchased are treated as a cancellation.

These amounts reflect a reasonable estimate of the costs we incur at each stage, which are difficult to determine precisely in advance because our materials are perishable and custom-sourced.

4.3 Cancellations by Us. We may cancel an order due to product unavailability, delivery constraints, pricing errors, or circumstances beyond our control. In such cases, you will receive a full refund of the amount paid.

5. Returns and Refunds

As a floral business working exclusively with perishable goods, all sales are final. Our full Return & Satisfaction Policy governs claims for defective or damaged products and is incorporated into these Terms by reference. Key points:

Claims must be submitted within 24 hours of delivery (for shipped orders, as shown by FedEx tracking).
A clear photograph of the arrangement must accompany all claims. For shipped orders, please also include a photo of the shipping box.
Natural variations in bloom appearance, color, and longevity are inherent to fresh flowers and are not considered defects.

6. Intellectual Property

All content on this Site, including text, photography, graphics, product names, logos, and brand elements, is the property of With Tiny Flowers LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from this Site without our prior written consent.

7. User Conduct

By using this Site, you agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to any portion of the Site or its related systems
Transmit any harmful, offensive, or disruptive content
Use automated tools to scrape, crawl, or extract data from the Site without our written permission

8. Privacy and Cookies

Your use of the Site is also governed by our Privacy Policy, which explains what information we collect, how we use cookies and advertising pixels from Meta, Google, and Pinterest, and how you can opt out. You can change your cookie choices at any time through the "Your Privacy Choices" link at the bottom of the Site.

9. Third-Party Links

The Site may contain links to third-party websites. These links are provided for your convenience only. We do not endorse and are not responsible for the content, privacy practices, or terms of any third-party sites. Accessing third-party links is at your own risk.

10. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, With Tiny Flowers LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any products purchased through it, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the applicable order.

Nothing in these Terms limits or excludes our liability for fraud, gross negligence, willful misconduct, personal injury, or any other liability that cannot be limited or excluded under applicable law, including California Civil Code Section 1668.

12. Indemnification

You agree to indemnify and hold harmless With Tiny Flowers LLC and its owners, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your use of the Site shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted to this page with an updated effective date. Changes apply only to orders placed and use of the Site after the updated effective date; orders placed before that date remain governed by the Terms in effect when the order was placed. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
